Nahhhhhhhhhhhhh. If someone can't provide their actual name on an official government issued ID, they should not qualify for that ID. As someone who got my Real ID, because it was required, there is no way to have met the requirements without providing proof of identity. How can the notion of Full Faith and Credit be taken seriously?
It isn't, evidently.
ReplyDeleteI've been looking into this with regard to another issue (the "Respect" For Marriage Act) and it seems the Full Faith and Credit Clause does not apply to state issued licenses. That's an act of an agreement by the state without regard to the federal government. In this case, I wonder if each state is operating on accepting that any level of driver's license is a legal form of ID. If there's no name, what state is then obliged to honor such a license? I would suspect there would be a legitimate cause of arrest in this case, if the putz was pulled over in a state other than that which was stupid enough to issue this license with no name on it.
Historically state issued IDs have been accepted in every other state. The principle still remains, and might be even more effective, if states are not required to recognize IDs from other states.
DeleteOne of these licenses certainly would not be acceptable for air travel or anything where ID is required.
My solution would be to check licenses at weigh stations, and refuse entry to anyone with one of these "licenses". It's already illegal to have a CDL if you can't speak English, this is just one more way to put pressure on illegal aliens.
