What in the hell is wrong with the citizens of NYC? The testimony clearly showed that Penny did not kill Neely, and that Neely was alive when the police finally showed up.
The very fact that Penny was charged at all is a travesty, and the fact that he hasn't been acquitted is a joke.
Without knowing for sure, I'm going to go out on a limb and guess that there are 1-3 jurors who are either black or extremely liberal who were never going to vote to acquit no matter what the evidence showed.
At this point declare a mistrial, take the loss, and move on. The justice system in NYC is clearly a joke.
Not really related, but it happened in NYC and the left wing response has been a travesty is the murder of Brian Thompson. The number of allegedly Christian leftists who are celebrating this callous murder is appalling. They they are trying to justify his murder because of his job is disgusting. I'm sure his surviving family feels comforted by y'all showing the grace, love, and compassion of the Jesus you claim to follow.

I'm really tired of those who defend those who have been the true threat. Penny did what any good Samaritan citizen of the entire world should have done: He interceded in a situation where regular people were threatened and subdued the threat. To pretend that "justice" demand Penny suffers for putting his own well being on the line for the sake of others is reprehensible, and the family of the dead guy should be ashamed of themselves for not doing more to prevent him from being the threat those in the vicinity of the incident believed him to be.
This is no more than just another racist attack on a good person. Because Penny is white and the dead guy is black, well, by golly it just has to be racism behind Penny's response to psycho behavior of the dead guy!
And of course the worst part of it all is that fewer people will be willing to stick their necks out to save others from true threats for fear that they, too, will be accused of murder. I wonder if those black dudes who assisted Penny will be tried in connection to the dead guy's death. I won't hold my breath.
Yeah, it pretty much stinks. You're right that we're less and less likely to see people expose themselves to risk in order to protect others. Between this, Trump, and letting actual violent felons off with a slap on the wrist, NYC is clearly uninterested in dispensing justice.
Stupid NYC citizens. Fortunately, they have privilege conservative white men like you to set them straight... to tell them how they should decide the case after hearing the evidence. After all, conservative white men like you know best.
Thank you for being smarter and more moral than all of NYC, in spite of not being fully informed or part of the trial process.
/end irony/
Dan
Stupid Dan for commenting with this idiocy. We know, beyond a shadow a doubt that Penny did not kill this fine upstanding citizen. We know beyond a shadow of a doubt that this fine upstanding citizen was threatening harm to innocent people. Penny intervened to protect innocent people, and people like you want to destroy him.
The NYC DA is literally allowing violent felons to walk free after reducing charges, yet he's obsessed with wasting taxpayer resources on this kind of crap.
It is always amusing to see your new commenting style. You drop in randomly, make an idiotic comment, then run back to the safety of your cesspool so you can avoid the responses your individual comments get. It's especially amusing when you drop this "conservative white men" crap as if you are somehow not afflicted with this privilege you whine about.
Well, we're certainly smarter and more moral than Dan, that's for certain! That's not really a brag given what a low bar he set.
It's amazing that with no more or less access to details than we have for this Penny case, Dan has attacked, demonized and condemned as great evil people like Donald Trump and conservatives in general. Here, he's again projecting this notion of conservative white men as racist, which is racist in itself. To simply write off opinion on a story like this as some "white" sinfulness is what embracing grace is all about.
In the meantime, I recall interviews with black people who felt threatened by Jordan Neely wherein they appreciated Penny's efforts to take control of the situation on their behalf. Dan just loves to pretend he's a champion for the poor oppressed black population. He loves being their white savior!
Yeah, Dan advocating for someone who was actively threatening to cause harm to innocent people and against someone who protected innocent people is a bizarre position for him to take. Especially since the gentleman doing the threatening was a less than wholesome individual, and the protector was able to restrain the attacker without killing him. Sounds like a win for safety of the innocent, but apparently a few innocent people need to get harmed waiting for the cops, and a few more violent felons need to be walking the street due to the DA.
Off topic, but I saw a picture of the police search for the UH CEO shooter and the NYPD has a bunch of cops who are not in any better physical condition than I am.
Dan advocating for someone who was actively threatening to cause harm to innocent people,/I>
Dan was advocating for a mentally ill, homeless man who had harmed no one. Dan is saying one should not be executed for the crime of being mentally ill. Dan is saying that holding a mentally ill and homeless man in a chokehold for a full minute after he'd gone limp is at least manslaughter.
HE HAD NOT HARMED ANYONE. IF this marine bully was actually concerned about this ill, unarmed man causing harm to someone, he could have stepped in between the man. He could have restrained him in a non-lethal hold (those exist, you know? Special ed teachers and others are required to learn how to restrain someone in a non-life-threatening way... maybe they don't teach that in the military, but one would hope...).
This was a mentally ill young man who had not harmed anyone and was not an eminent threat to anyone and this man took it on himself to apply his military training to put him in a choke hold and hold him in it until long after he'd stopped struggling.
Feel free to disagree.
But what you do for the least of these - the poor, the ill, the mentally ill, the homeless, the marginalized - you do for and to Jesus. This man just strangled Jesus to death. (IF you take the Bible literally, anyway).
actively threatening to cause harm to innocent people and against someone who protected innocent people
THREATENING to cause harm is one thing. By ALL means, any person should step between someone threatening to cause harm and innocent people. I FULLY support helping de-escalate such scenarios. I MYSELF, have done so. And yet, I've never killed anyone to do it.
This man did not protect innocent people by killing this poor, sick man. He killed a mentally ill man who needed assistance, not a choke hold.
"Off topic, but I saw a picture of the police search for the UH CEO shooter and the NYPD has a bunch of cops who are not in any better physical condition than I am."
Given the crap cops have to take these days, including the defunding bunk, I'll bet the standards have been lowered. Which means I could wear them snappy uniforms and carry lethal weapons, too...if I wanted to live in NYC.
Dan clearly doesn't read accurately and chooses to respond to shit he makes up, instead of what people actually say. I guess Dan would be happier had this fine young gentleman actually harmed some innocent people first, before anyone stepped in. FYI, this fine young gentleman was offered treatment and stable housing, he refused.
FYI, Penny's restraint did not kill him.
I do love it when Dan defends people who threaten to harm others. He clearly should have waited until someone was actually harmed, because we should never intervene when someone is merely threatening people in a situation where they do not have the option to escape.
He didn't kill anyone, Neely was alive when he was released. If you assume that Neel's threats were not serious, then you can construct a fantasy world where none of the innocent people trapped on a subway were in danger.
He'd refused assistance, but that's not his fault, right?
Now we have BLM and his father out threatening violence and looking for a payday, why did neither of them give him the assistance he needed?
I'm absolutely sure that standards have been lowered, especially in retention.
Best exchange from the trial.
Q: "So what did Mr Neely say, to make you think he was a threat?
A: "I'll hurt everyone here! I'll KILL you!!! I don't care if I go to prison!!!"
I now understand Dan's position. It is completely reasonable not to take someone who says these things at their word. One must assume that they do not intend to carry out their direct, specific, threats of harm but that they are really mentally ill and simply need a hug. It's completely unreasonable to restrain this person until they stop struggling, but are still living, in order to prevent him from carrying out his specific, direct, threats.
Next time, let a few innocent people be harmed/killed before taking action and Dan will applaud you.
Neely, as part of a plea agreement which resulted from him punching a 67 year old woman in 2021 was given free access to stable housing and health care at a treatment facility in the Bronx. He left after 13 days.
It seems like he bears some/significant responsibility for not availing himself of the treatment he needed in 2021, and it seems like if his father is looking to cash in might have intervened as well.

If you want to blame someone for his death, blame the NYC DA. This guy should have been in jail.

Look, he used homophobic slurs on video.
But Dan is going to keep defending him.
